A companion relationship is a relationship between two adults living together as a couple on a genuine domestic basis, but who are not married or in a de facto relationship.

They can be related by family and be of the same or opposite sex. Property disputes between companion couples where the relationship has existed for more than three years are covered by the Domestic Partners Property Act If a former partner wishes to apply to the court to resolve a dispute over property, all of the following requirements must be met [ Domestic Partners Property Act SA s 9 1 ]:. For companion relationships not covered by the Domestic Partners Property Act SA , rights to property on the breakdown of a relationship are governed by the ordinary rules of property, trusts and contract.

Applications must be made within one year after the end of the relationship unless the court, after considering the interests of both parties, is satisfied that an extension is necessary to avoid serious injustice to the applicant [Domestic Partners Property Act SA s 9 3 ]. Given the potential future size of superannuation entitlements it is very difficult to determine in which court to issue proceedings. The Domestic Partners Property Act does not give a person an 'automatic' share of their partner's property.

There are a number of considerations that a court will consider when determining what entitlements a person has. A court has powers [Domestic Partners Property Act SA ss 11,14] to consider matters relevant to the just and equitable division of property and in particular will consider:.

When deciding the division of property, the court may make orders it considers necessary to divide the property of either or both of the partners between them in a way that is just and equitable [Domestic Partners Property Act SA s 10 1 ]. For example the court may make orders:. As far as practicable the court will attempt to finalise all matters to avoid further proceedings between the parties [Domestic Partners Property Act s 12].

However, the Act does not exclude other forms of remedy or relief [Domestic Partners Property Act s 16]. Where one of the partners dies, an application for the division of property may be made or continued by or against the legal personal representative of that partner [Domestic Partners Property Act s 9 4 ].

This application may only relate to property that is undistributed at the date of the application. At the conclusion of a court case the loser is often ordered to pay the winner's legal costs. Although the Domestic Partners Property Act SA does not specifically deal with the question of costs, the court may make orders for costs at the conclusion of a case.

Almost everyone would think that they are in love with someone once they spend most of their precious time with them. Back then, distance was something that I was afraid of in a relationship. It bothered me to think that my special someone and I would eventually drift away from each other once we lose that physical touch. What if one of us tires from talking with each other virtually? To be replaced by someone else just because that person is physically present for your significant other.

There are many misconceptions about the term soul mate and that of a life partner. A soulmate is someone who comes into your life to teach you, enrich you, push you and transcend you into a higher state of being and consciousness. A life partner is a companion whom you trust and depend on during your life. Soulmates can enter your life masked as friends, family members, and lovers. They fill a passion and desire that needs to be learned. Once the assignment and guidance is completed a soul mate usually exits the picture, oftentimes leaving an inconceivable amount of heart ache. A life partner has similar interests in your life. This person is the cheerleader, the pillar of strength and support that encourages you to take risks. Unlike the soulmate, a life partner sticks around regardless of what obstacles and challenges are ahead.

There are many reasons for dating and age rarely ever plays into the equation of happiness when people date someone with whom they enjoy spending time. Having a successful dating experience sometimes depends on what each person is searching for in a relationship. Dating for companionship and dating for romance each have different characteristics as well as separate levels of communication and comfort levels. Determining which level you want in a dating experience can leave you happy, secure and fulfilled in a relationship. Some people search for a companion to out to dinner with, or to the theater, or a walk in the park.

Being in a relationship with someone you're actually in love with is way different than being with someone just because it's convenient. For some, being in a relationship of convenience is perfectly fine for where they're at in life.

Passion is great, it feels great, and there is nothing like passionate interactions which can include the deep passionate sexual interaction or the passion of just being together with the person you desire.

The words are generic, and the important thing is agreeing with each person what your relationship means and being able to simply communicate that with others.
